Payment Policy
Invoices
Unless otherwise noted, ALL INVOICES are "due in full on receipt." Any monies paid above the invoiced amount will be credited to your account. Your account is "PAST DUE" if Outdoor Studios Photography (ODSP) does NOT receive payment within 10 days of the invoice date. If your account is PAST DUE, any or all services will be canceled, without exception, until all monies are paid to bring your account current. A Late Fee of 10.0% will accrue monthly, as well as a $25.00 re-billing fee, on accounts unpaid after 10 days. If an invoice becomes 30 days past due, ODSP will attempt to collect the past due amount through a local collection agency and additional charges may be incurred. ODSP products & services are NOT REFUNDABLE in any way whatsoever once delivery of product or service has been accepted. In the event that ODSP has to take legal action to enforce the provisions of this section, the prevailing party shall be entitled to its reasonable expenses, including attorney’s fees, regardless of whether in house or outside counsel is employed.
Deposits
Deposits are required to retain ODSP to perform the services specified herein. At such time as product or services are rendered, the deposit shall be applied to the total amount and you shall be responsible for the balance. The deposit is non–refundable.
Cancellation Policy
To cancel your services, ODSP must receive written notice mailed to 33080 Bellemont Rd. Yoder, CO 80864 at least 30 days prior to the session date. Cancellation charges will be applied as follows: 100% of the agreed amount where cancellation occurs within ten (10) business days and 50% where cancellation occurs within twenty (20) working days of the date agreed for works/sessions to be carried out. Costs incurred by ODSP (including but not exclusively; deposits or payments-in-full for equipment hire, locations, travel, transportation, printing, models, assistants and other professional services) will be invoices to you after cancellation confirmation. There are no exceptions to this policy.
Rescheduling
In the event that you request a rescheduling of works or session to be carried out, no additional charge will be made to you provided that we can be reschedule at a mutual convenience to both you and ODSP. Failure to arrange a mutually convenient rescheduling will constitute a cancellation and the above terms and conditions will apply.
Copyright and Reproductions
ODSP retains full, unlimited, world-wide copyright on all photographs supplied, including but not limited to negatives, transparencies, proofs, digital files (including RAW, Tiff, JPEG), and previews shall be the exclusive property of ODSP unless otherwise granted to you in a written license agreement. ODSP shall have the exclusive right to make reproductions for use in portfolios, samples, self-promotions, entry in photographic contests or art exhibitions, advertising, sale (commercial or private), illustration, editorial use, or for display within or on the outside of the ODSP studio, including printed materials, media on the World Wide Web, and any current or future media, unless otherwise granted to you in a written license agreement.
